These Terms and Conditions form the agreement between you and Bay Area Scenic Air Tours LLC ("we," "us," or "our") for scenic air tours departing from San Carlos Airport, and govern your use of bayairtours.com. By booking a flight, paying for a booking, or using our website, you confirm you have read, understood, and agreed to these terms on behalf of yourself and every passenger in your party.
About our service
We operate private, non-stop sightseeing flights that depart from and return to San Carlos Airport. These are aerial sightseeing tours for the purpose of viewing the San Francisco Bay Area from the air. We are not a scheduled air carrier and we do not provide point-to-point transportation, charter transport, or flight instruction. Every flight begins and ends at the same airport.
Who may book
You must be at least 18 years old to make a booking. By booking, you confirm you are authorized to accept these terms for every passenger in your party, and that you will share the relevant parts with them before the flight.
Bookings and confirmation
A request to book is not a confirmed booking. Your flight is confirmed only once we have accepted it and payment has been received. Until then, the date and time remain subject to aircraft and pilot availability.
We confirm bookings by email or phone. Please review your confirmation carefully and tell us promptly if any detail is wrong, particularly the date, time, passenger count, or passenger weights.
Pricing and payment
Prices are quoted per flight for up to two passengers, in U.S. dollars, and include the aircraft, pilot, and route described. A third passenger may be added for an additional fee. Published pricing may change at any time, but confirmed bookings are honored at the price agreed upon at the time of booking. Any applicable taxes or fees will be disclosed before payment.
Payment is accepted by credit or debit card through Stripe, our payment processor. We do not store full card numbers. If a payment is declined, reversed, or charged back without valid cause, we may cancel the booking.
Passenger limits, weight, and balance
Each flight carries up to three passengers, subject to strict limits:
- 250 lbs maximum per individual passenger
- 650 lbs maximum combined across all passengers
These are aircraft performance limits, not preferences. They cannot be waived, adjusted, or negotiated for any reason.
You must provide accurate passenger weights when booking. We understand this is personal, and we treat it confidentially — it is used only for the safety calculation every flight requires.
If actual weights on the day differ materially from those provided and the flight cannot be operated within safe limits, we may need to reduce the party size, reschedule, or cancel. In that case the customer cancellation terms apply, because the aircraft and pilot were reserved for you.
Children and minors
Children above five years of age are welcome. Every passenger, whatever their age, must occupy their own seat with their own seat belt. No passenger may be held on a lap during any phase of flight, and infants cannot be carried. Passengers under 18 must be accompanied by a parent or legal guardian, who signs any required waiver on their behalf.
Arrival, check-in, and identification
Please arrive 10 to 15 minutes before your scheduled departure so we can complete check-in, review the passenger manifest, and deliver the safety briefing. We meet you inside the main terminal. Airport access rules may require photo identification, so please bring it.
If you arrive late we will try to accommodate you, but your flight may be shortened to fit the remaining window, with no refund for the reduced time. If lateness makes the flight impossible to operate within the schedule, it is treated as a no-show.
Health, mobility, and fitness to fly
Scenic flights involve boarding a small aircraft with limited cabin space, requiring a degree of mobility and the ability to enter and exit with minimal assistance. Cabin conditions can include noise, vibration, temperature changes, and light turbulence.
Please tell us before booking if any passenger has a medical condition, mobility limitation, recent surgery, or pregnancy that may be affected by flight, so we can discuss whether the flight is suitable. We are not medically trained and cannot assess fitness to fly on your behalf; if in doubt, consult your physician. We may decline to carry a passenger where we reasonably believe flight would present a risk to that passenger or to the safety of the flight.
Scuba diving: Flying soon after scuba diving can increase the risk of decompression sickness. Passengers who have recently scuba dived are responsible for following applicable recommended surface-interval guidelines before flying. If you have any concerns about whether you are fit to fly after diving, consult a qualified diving or medical professional before booking.
Pilot authority and operational decisions
The pilot in command holds final authority over every aspect of the flight, including whether it departs, the route, altitude, duration, and whether it is shortened or ended early. This authority exists for your safety and is not subject to negotiation or refund pressure.
Flights are subject to weather, visibility, wind, cloud, air traffic control instructions, temporary flight restrictions, airspace closures, airport conditions, and aircraft airworthiness. Any of these may require us to delay, shorten, reroute, or cancel.
Cancellation by us
If we cancel for weather, maintenance, airspace, or any other operational reason, you may choose a full refund or a free reschedule. We will contact you as early as we reasonably can. If we shorten a flight after departure for operational reasons, we may offer a partial refund or credit proportional to the time not flown.
Cancellation by you
Cancellations and reschedules made at least 24 hours before departure are accepted at no charge. Requests made less than 24 hours before departure incur a charge of 50% of the booking total. Failure to appear is treated as a same-day cancellation. Full details are in our Refund Policy, which forms part of these terms.
Route requests and expectations
We welcome requests for particular landmarks or areas and accommodate them where we can. All routing remains subject to FAA regulations, airspace restrictions, air traffic control instruction, weather, and the pilot's judgment. A requested route, landmark, altitude, or photographic angle is never guaranteed.
Photographs and descriptions on our website illustrate the general experience. Actual views vary with weather, visibility, haze, season, time of day, and routing. Variation in the view is not grounds for a refund.
Passenger conduct
All passengers must follow crew instructions at all times, including on the ramp and around the aircraft. Ramp areas are active movement areas and carry real hazards.
We may refuse to carry, or end a flight early without refund, any passenger who:
- Appears intoxicated or under the influence of drugs
- Behaves in a disruptive, threatening, or unsafe manner
- Interferes with the operation of the aircraft or the pilot's duties
- Tampers with aircraft controls, doors, or equipment
- Refuses to comply with safety instructions
Smoking and vaping are prohibited on board and anywhere on the ramp and in the aircraft.
Baggage and personal items
Cabin space is limited. Please bring only small personal items such as a phone or camera, and secure loose items during flight. We are not responsible for personal property lost, damaged, dropped, or left behind. We recommend a wrist or neck strap for cameras and phones.
Photography and recording
You are welcome to take photographs and video, provided it does not interfere with the operation of the aircraft or the pilot's duties. Equipment must never be extended outside the aircraft.
We may occasionally photograph or record flights for promotional use. If you prefer not to appear in such material, tell us before your flight and we will respect that.
Assumption of risk
Flight in a general aviation aircraft carries inherent risks that cannot be entirely eliminated, however carefully the flight is planned and conducted. By booking and boarding, you acknowledge those risks, confirm participation is voluntary, and accept them on behalf of yourself and any minor for whom you are responsible.
All passengers may be required to read and sign a separate liability waiver before boarding. Refusal to sign means the passenger cannot fly, and standard cancellation terms apply.
Limitation of liability
To the fullest extent permitted by California law, our total liability arising out of or connected with your booking, your flight, or your use of this website is limited to the amount you paid for that booking.
We are not liable for indirect, incidental, special, or consequential losses, including missed connections or onward travel, accommodation costs, lost time, lost enjoyment, or lost profits, arising from a delayed, shortened, rerouted, or cancelled flight.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence.
Indemnity
You agree to indemnify us against any claim, loss, or expense arising from your breach of these terms, from inaccurate information you provide, or from the conduct of any passenger in your party.
Gift bookings and vouchers
Flights may be purchased as a gift. The recipient is bound by these terms in the same way as the purchaser, including the weight limits and age requirement. Refunds for gift bookings return to the original purchaser. Vouchers are valid for the period stated and are not redeemable for cash.
Website use and intellectual property
All content on bayairtours.com, including text, photographs, graphics, and branding, is owned by us or used with permission, and may not be copied, reproduced, or republished without our written consent. You may not use the site for any unlawful purpose or attempt to interfere with its operation or security.
The website is provided on an "as is" basis. We aim to keep information accurate and current but do not warrant that it is free from error or that the site will be uninterrupted.
Force majeure
We are not liable for failure or delay in performing our obligations where it results from events beyond our reasonable control, including severe weather, natural disaster, wildfire smoke, airspace closure, government or regulatory action, labor disruption, utility or communications failure, or public health emergency. Where such an event prevents your flight, we will offer a reschedule or refund as set out above.

Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in San Mateo County, California, and you consent to the jurisdiction of those courts. We encourage you to contact us first so we can try to resolve the matter informally.
Severability and entire agreement
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions continue in full effect. These terms, together with our Privacy Policy and Refund Policy, form the entire agreement between us regarding your booking.
Changes to these terms
We may revise these terms from time to time. The version in effect when your booking is confirmed governs that booking. The current version is always on this page, with the revision date shown at the top.
